I don't consider it an error, but there shouldn't be rules concerning when you use "less" and when you use "fewer". There's a long standing debate over this, although I think it might just be a Shibboleth so Midwesterners can distinguish Chicago residents from the East Coasters. ...

The 22 year old producers* at cnn.com were using those words every couple of days for a while -- usually in the same story. I swear my blood pressure rose slightly everytime I saw them.
